Terms of Service

These Terms govern use of PureMetrix (app.puremetrix.org and collect.puremetrix.org), operated by Lydia Rebers, Destouchesstr. 3, 80803 Munich, Germany. By signing up or using the service you agree to these Terms and the integrated Data Processing Agreement (DPA).

1. Summary

  • Free plan: New accounts start on Free (limits apply). No card required to start.
  • Traffic spikes: We do not charge automatic overage fees for occasional spikes.
  • Cancel anytime: Cancel a paid subscription in account settings; access continues until the end of the prepaid period.
  • Your metrics: You control your site metrics. We do not sell them.
  • Privacy: Analytics processing is described in our Privacy Policy.

2. Account

  • You must be at least 18 or act for a business.
  • You are responsible for access to your account (magic link or other login methods).
  • Do not use the service for unlawful purposes or to infringe third-party rights.

3. Plans, payment, taxes

  • Free: Use within Free pageview and site limits. Paid features require a paid plan.
  • Paid plans: Billed in advance (monthly or annually) via Stripe.
  • Taxes: Applicable taxes are calculated at checkout based on your billing details and shown before payment. The invoice is decisive.

4. Fair use

  • Each plan includes monthly pageviews and custom events.
  • No automatic penalty overage fees for short spikes.
  • If volume exceeds your plan for two consecutive months, we may ask you to upgrade or cancel.

5. Cancellation & deletion

  • Cancel under Settings → Subscription.
  • After cancelling a paid plan, access continues until the prepaid period ends; no further charge for that plan.
  • You may delete your account and associated metrics; we delete without undue delay, subject to legal retention (e.g. invoices).
  • On Free, collection stops at the monthly cap. For expired unpaid paid plans, collection stops; we notify before permanent purge after a grace period.

6. Right of withdrawal (EU consumers)

If you are a consumer in the EU/EEA and conclude a distance contract for a paid subscription, you generally have a 14-day right of withdrawal from the day of the contract.

  • How to withdraw: Clear statement by email to [email protected] (or cancel in Settings if that ends the contract within 14 days). Include your account email.
  • Effects: We refund payments for the withdrawn contract without undue delay, at latest within 14 days, using the same payment method where possible.
  • Early performance: If you ask us to start the paid service during the withdrawal period and acknowledge that you lose the right of withdrawal once performance has begun, the right may expire under applicable EU rules for digital content/services. Details are shown at checkout where required.
  • Outside the EU: Local mandatory consumer rights remain unaffected where they apply. We do not invent additional cooling-off regimes beyond what the law requires.

7. Acceptable use of event data

  • Do not send sensitive personal data (card numbers, passwords, health data, national IDs, etc.) in custom event properties.
  • Do not try to re-identify individual visitors by circumventing anonymisation.

9. Liability

  • Except where liability cannot be limited by law, we are not liable for indirect or consequential loss (including lost profits or data).
  • Except where mandatory law provides otherwise, total liability is limited to fees you paid us in the 12 months before the claim arose.
  • Liability for intent, gross negligence, and injury to life, body, or health is not limited.
  • Mandatory consumer rights remain unaffected.

10. Governing law & venue

  • German law applies.
  • If you are a consumer, mandatory protective provisions of the law of your country of residence remain unaffected.
  • If you are a merchant, a legal entity under public law, or a special fund under public law, exclusive venue is the operator’s seat in Germany.
